1. ACCEPTANCE OF TERMS
By accessing or using the website located at performancecoatingsolutions.com (the "Site"), scheduling any service,
submitting any inquiry, or communicating with us via any channel — including SMS, email, phone, or web forms — you
("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these
Terms, do not use this Site or our services.
These Terms constitute a legally binding agreement between you and Performance Coating Solutions ("PCS," "we," "us,"
or "our"), a Florida-based automotive protection and detailing company.
2. SERVICES OFFERED
Performance Coating Solutions provides the following services (collectively, "Services"):
Ceramic Coating — paint protection, hydrophobic coatings, and sealant applications for automotive, marine, and aircraft surfaces
Paint Protection Film (PPF) — self-healing film installation on vehicle surfaces
Window Tinting — residential-grade and automotive window film installation
Auto Detailing — interior and exterior detailing packages
Vehicle Wraps — full and partial vinyl wrap installation
Professional Car Wash & Wax — maintenance wash and wax services
Aircraft & Marine Coating — ceramic coating services for non-automotive vehicles
All Services are subject to availability, vehicle condition assessment, and final technician approval upon inspection. We
reserve the right to refuse, modify, or discontinue any Service at any time.
3. QUOTES, ESTIMATES, AND PRICING
3.1 All pricing provided via the Site, SMS, email, phone, or in-person consultation constitutes an estimate only and is not
a guaranteed final price. Final pricing is confirmed in writing at the time of vehicle drop-off following inspection.
3.2 Pricing may vary based on vehicle size, vehicle condition, surface contamination, existing paint damage, or
corrections required prior to service.
3.3 Promotional pricing, discounts, or special offers are subject to expiration and availability. They may not be combined
with other offers unless expressly stated.
3.4 Sales tax will be applied to all applicable transactions in accordance with Florida law.
4. APPOINTMENTS, DEPOSITS, AND CANCELLATIONS
4.1 Scheduling. Appointments may be booked via the Site, by phone, by SMS, or through any booking tool linked from
the Site. Booking an appointment does not constitute a guaranteed reservation until confirmed by PCS via written or
electronic communication.
4.2 Deposits. A deposit may be required to secure your appointment. Deposit amounts will be disclosed at the time of
booking and are applied toward the total cost of the Service.
4.3 Cancellations. Cancellations made with less than 24 hours' notice may result in forfeiture of the deposit.
Cancellations with 24 hours or more advance notice may receive a full deposit refund or deposit credit at PCS's
discretion.
4.4 No-Shows. Failure to appear for a scheduled appointment without notice will result in forfeiture of any deposit paid.
4.5 PCS Cancellations. We reserve the right to cancel or reschedule appointments due to weather conditions, equipment
failure, staff availability, or other operational circumstances. We will provide advance notice and reschedule at no penalty
to you.
5. VEHICLE INSPECTION AND LIABILITY
5.1 Pre-Service Inspection. Customer acknowledges that PCS will perform a pre-service inspection of the vehicle. Any
pre-existing damage or conditions identified during inspection will be documented and communicated to the Customer
prior to commencing work.
5.2 Customer Disclosure. Customer is responsible for disclosing any known pre-existing damage, prior paint repairs,
aftermarket modifications, or conditions that may affect service outcome. Failure to disclose known conditions may affect
warranty coverage.
5.3 Vehicle Left on Premises. While vehicles are in our care, PCS maintains general liability insurance and exercises
reasonable care. PCS is not responsible for loss or damage resulting from acts of God, theft, vandalism, or
circumstances beyond our reasonable control.
5.4 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PCS'S TOTAL LIABILITY
TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE
GIVING RISE TO THE CLAIM. IN NO EVENT SHALL PCS BE LIABLE FOR INDIRECT, INCIDENTAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES.
6. SERVICE WARRANTIES
6.1 PCS provides warranties on specific services as disclosed in writing at the time of service completion. Warranty
terms vary by product, coating tier, and installation type.
6.2 Warranties are non-transferable and apply only to the original Customer and vehicle.
6.3 Warranty coverage is void if: (a) the vehicle is improperly maintained following service; (b) non-recommended
products are used on coated surfaces; (c) damage results from accidents, misuse, or environmental conditions; or (d)
unauthorized repairs or modifications are made to treated surfaces.
6.4 Warranty claims must be submitted in writing with supporting photos within the warranty period. PCS reserves the
right to inspect the vehicle before approving any remedy.
7. AUTOMATED COMMUNICATIONS AND SMS MESSAGING
7.1 Consent to Receive Communications. By submitting your phone number through any form on this Site, requesting a
quote, booking an appointment, or texting our business number, you expressly consent to receive automated and
manually-sent SMS/MMS messages and phone calls from PCS or its authorized service partners, including appointment
confirmations and reminders, service updates, follow-up and review requests, promotional communications (where
separately opted in), and AI-assisted automated responses to your inquiries.
7.2 AI-Assisted Messaging. You understand and acknowledge that some communications you receive from PCS —
including responses to SMS inquiries — may be generated or assisted by artificial intelligence (AI) automation systems.
AI responses are designed to be accurate and helpful but are not a substitute for final human review on all binding
matters.
7.3 Message and Data Rates. Standard message and data rates may apply depending on your mobile carrier and plan.
7.4 Opt-Out. You may opt out of receiving SMS communications at any time by replying STOP to any text message.
Please allow up to 5 business days to process opt-out requests. Opting out of marketing messages will not affect
transactional or appointment-related communications necessary to fulfill your booked service.
7.5 Help. Reply HELP to any SMS message for assistance or contact us directly at the information listed in Section 14.
8. ONLINE CONTENT AND ADVERTISING
8.1 PCS may run paid digital advertising campaigns, including on Meta platforms (Facebook and Instagram), promoting
our Services. Advertised pricing and availability are subject to change.
8.2 Content appearing on our social media channels — including educational videos, before-and-after imagery, and
service demonstrations — is produced for informational purposes and may not reflect results achievable for every vehicle
or condition.
8.3 Customer reviews and testimonials featured on the Site or in advertising represent individual experiences and are not
guarantees of outcome.
9. INTELLECTUAL PROPERTY
9.1 All content on this Site — including text, images, videos, logos, and graphics — is owned by or licensed to
Performance Coating Solutions and is protected by applicable copyright, trademark, and intellectual property laws.
9.2 You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without
our prior written consent.
9.3 The PCS name, logo, and service marks are trademarks of Performance Coating Solutions. Use of these marks
without written authorization is prohibited.
10. THIRD-PARTY LINKS AND SERVICES
This Site may contain links to third-party websites, platforms, payment processors, or booking tools. PCS is not
responsible for the content, accuracy, or privacy practices of any third-party platform. Your use of linked third-party
services is subject to their own terms.
11. USER CONDUCT
When interacting with our Site or communicating with us, you agree not to: (a) submit false, misleading, or fraudulent
information; (b) use our contact forms, SMS channels, or booking tools for spam or harassment; (c) attempt to interfere
with or gain unauthorized access to our Site or systems; or (d) impersonate PCS staff or other customers.
12. DISPUTE RESOLUTION
12.1 Informal Resolution. In the event of any dispute, you agree to first contact PCS directly and allow 30 days for
good-faith resolution before initiating any formal proceeding.
12.2 Governing Law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law
principles.
12.3 Jurisdiction. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts
located in Broward County, Florida.
12.4 Waiver of Class Action. TO THE EXTENT PERMITTED BY LAW, ALL DISPUTES SHALL BE RESOLVED ON AN
INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE
ARBITRATION.
13. MODIFICATIONS TO THESE TERMS
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site with
an updated "Last Updated" date. Your continued use of the Site or our Services following such posting constitutes your
acceptance of the revised Terms.
